Commutation Amount should be stopped before 12 Years demanded by the veterans and orders have also been issued by the Court and Tribunals in this regard.
Voice of Ex Servicemen Society has, a registered association of Ex-Servicemen JCOs/NCOs/Ors Movement has requested through a representation to Defence Minister of India, South Block, New Delhi through Secretary, Department of Ex-Servicemen Welfare South Block, New Delhi -110011. The request is regarding recovery of commutation upto 11 years instead of 15 years. Content of the letter is reproduced here –
1. Kindly refer to the following court orders to stay recovery of commutation after 11.5 years (copies of the court orders are enclosed):
(a) High Court Punjab & Haryana Chandigarh stay order on Writ Petition CWP 9426-2023 Shila Devi & Ors. Vs State of Punjab & Ors & 2490-2024 Ram Swaroop Jindal vs. State of Punjab & Ors
(b) Armed Forces Tribunal stay order on OA 2366 with MA 2813/2024, AVM (Recd) SK Gagnerja Accts Vrs Union of India and Ors.
2. Based on the High Court Punjab and Haryana Chandigarh stay order quoted at para 1(a) above. Punjab and Haryana Govt have issued necessary directions to their all departments to stop recovery of commutation after 11.6 years to their ex employees.
3. Since AFT Principal Bench New Delhi have also issued a similar stay order on OA vide paragraph 1(b) above, you are requested to kindly issue the necessary directive to the CGDA to stop the recovery of commutation in respect of retired or discharged Armed Forces personnel of all three services to avoid litigation.
A copy of this letter has also been forwarded to the CGDA, Delhi Delhi Cantt – for necessary action please.
