OROP 3 from 01 July 2024 : Govt Orders and instructions of Supreme Court in Support

Govt of India, Ministry of Defence, Dept of Ex-Servicemen Welfare has declared the methodology for implementation of OROP for all ranks in Indian Armed Forces vide their letter No 12(1)/2014/D (Pen/Pol) – Pt-II dated 07 Nov 2015.  According to the OM, OROP revision to be carried out in every 5 years wef 01 July 2014.  Accordingly the 2nd revision taken place on 01 July 2019. 

Hon’ble Supreme Court has instructed on revision of pension under the OROP vide their Order dated 20 Mar 2023 on Misc Application No 219 of 2023 in Writ Petition (Civil) No 419 of 2016 filed by Indian Ex-Servicemen Movement VERSUS Union of India Dept of Ex-Servicemen Welfare Ministry of Defence. 

Govt of India, Ministry of Defence, Dept of Ex-Servicemen Welfare vide their letter dated 07 Nov 2015 in Para – 2  stated that “It has been decided to Implement “One Rank One Pension” (OROP) for the Ex-Servicemen with effect from 01 Jul 2014. At para – 3 (V) of the said letter, it has also been clarified that, in future, the pension would be re-fixed every 5 years.  Accordingly the 2nd revision was carried out with effect from 01 July 2019. So, the 3rd revision is due with effect from 01 July 2024.    

In the verdict of Hon’ble Supreme Court Order vide Para 13 ordered that, during the Course of Hearing, it has been Clarified Specifically by the Learned Attorney General for India, On Instructions, that the Deferral of Payment in terms of the Present Order shall not have any Bearing on Computation of Dues for the Purpose of the Next Equalisation, when it Falls Due. 

So, it may be expected that the Equalisation of Pension (OROP-3) will be Carried out well in time and the Pension would be Revised wef 01 Jul 2024. The Revised Pension on Equalisation (OROP-3) would be paid to the Pensioners with effect from the Pension of July 2024. 

Numerous representations have been made by the veterans to look into the matter for an  early and positive response in this regard by the PCDA/concerned authority as a Welfare towards the Senior/Super Senior Ex-Servicemen and Single Ladies Pensioners. 

You might have seen OROP-3 tables published in social media which have no authentic value as these are not based on any Govt established formulae for OROP-3.  We expect a rational approach while fixing the pension in OROP-3 which may ensure definite benefit for all ranks.
