Amendments/Modifications that may be required in the recruitment rules for reemployment of Ex-Servicemen in group ‘B’ & ‘C’ posts in the Government

The Ministry in a written brief submitted the following information on Amendments/ Modifications that may be required in the Recruitment Rules for re-employment of Ex Servicemen, in Group ‘B’ & ‘C’ posts in the Government. ‘As per DoPT Gazette Notification No.39016/10/79-Estt.(C) dated the 15th December, 1979 and DOP&T No. 36034/1/2006-Estt.(Res) dated 04.10.2012, 10% of the vacancies in Group ‘C’ and 20% of the vacancies in Group ‘D’ posts, including permanent vacancies filled initially on a temporary basis and temporary vacancies which are likely to be made permanent or are likely to continue for three months and more, to be filled by direct recruitment in any year shall be reserved for being filled by ESM.

Consequent to the implementation of the 6th Central Pay Commission (CPC) recommendation, Group ‘D’ posts were merged with Group ‘C’ posts. Further, some of the Group ‘C’ posts were upgraded to Group ‘B’ posts. Accordingly, an amendment is required to be carried out to amend DOP&T No. 36034/1/2006-Estt. (Res) 04 0ct 12 to increase the percentage of reservation in Group ‘C’ posts from 10% to 20% and to provide for 10% reservation in Group ‘B’ posts for ESM to make up the deficiency of posts caused due to the merger of Group ‘D’ posts with Group ‘C’ posts and upgradation of Group ‘C’ posts to Group ‘B’ posts.

Accordingly, a proposal to introduce reservation of 10% in Group (Non-gazetted) Direct Recruitment posts and to provide reservation of 20% in Group ‘C’ Direct Recruitment posts in Central Government jobs was referred to DoPT. DoPT vide their O.M. No. 36034/1/2006-Estt.(Res) dated 23 May, 2016 have requested to Ministry of Defence to provide the following information:

i) The rationale behind increase in percentage of reservation in Group ‘C’ posts for ESM as it is percentage-wise reservation for ESM. ii) Department-wise category of posts, its sanctioned strength and filled up position which have been upgraded from Group ‘C’ posts to Group ‘B’ posts. MoD has also been requested to take up the matter with Ministry of Home Affairs (MHA)and Department of Financial Services to find out the reason for non-filling up of posts reserved for ESM. The above information will be provided to DoPT after receipt of inputs from MHA & Deptt of Financial Services for further examination of the proposal at their end.

The Ministry further submitted that a proposal to introduce reservation of 10% in Group ‘B’ Direct Recruitment posts and to increase reservation upto 20% in Group ‘C’ Direct Recruitment posts was forwarded to the Ministry of Defence vide this Office Note No 0515/Gen/DGR/Emp-3 dated 18 Oct 2012 and Note No 0515/Gen/DGR/Emp-3 dated 16 Sep 2014.

MOD vide their Noting dated 30 Nov 15 recorded on our File No. 0515/Gen/DGR/Policy/2015, requested this Directorate to submit detailed proposal separately for each case with full justifications before the same could be considered by them in consultation with DOP&T. Accordingly a Statement of case vide our File 0515/Gen/Policy/2015 dated 31 Mar 2016 has been taken up with MOD for amendment to DOPT GSR 757(E) dated 04 Oct 12 to provide for increase in percentage of reservation from 10% to 20% in Group ‘C’ and to provide for reservation of 10% in Group ‘B’ in direct recruitment in Central Civil Services and Posts.’

It is very unfortunate that, since then all these files have been kept pending without any reason.  No further actions have been taken by any authority. Exservicemen are still deprived of their legitimate right and they are debarred from participating in the higher administration of the state and centre. ESM associations may approach the Govt in this regard for an appropriate action.
